Mohamed Osman Abdile Charged with Sh296 Million Theft and Money Laundering

A former employee of a leading Nairobi shopping complex has been charged with stealing over Sh296 million over a seven-year period.

The accused, Mohamed Osman Abdile, appeared before a Nairobi court facing multiple criminal charges.

According to the Director of Public Prosecutions (DPP), Abdile allegedly stole the money from his employer and later laundered it through various bank accounts and companies.

30 Criminal Counts Filed

Mohamed faces 30 counts, including:

  • Conspiracy to commit a felony

  • Stealing by servant

  • Stealing

  • Money laundering

  • Possession of proceeds of crime

He is jointly charged with his company, Fatzam Enterprises Limited (FEL), and fellow director Hussein Ibrahim Barre, who failed to appear in court to take plea.

Sh296 Million Allegedly Stolen Over Seven Years

The court heard that between January 1, 2018 and September 2024, Abdile allegedly stole Sh296,069,084 belonging to businessman Abdi Mohamed Ali.

Prosecutors said the funds came into his possession through his employment, where he was entrusted with handling business finances.

Funds Traced to Multiple Bank Accounts

Investigators told the court that Abdile deposited the stolen funds into accounts held at:

  • Kenya Commercial Bank (KCB)

  • Absa Bank

  • Equity Bank Limited (EBL)

All accounts were reportedly located in Eastleigh.

Out of the total amount:

  • Over Sh116 million was allegedly laundered

  • More than Sh107 million was retained as proceeds of crime

Alleged Use of Fatzam Enterprises Limited

The prosecution further alleged that Abdile used Fatzam Enterprises Limited to transfer large sums to other companies and individuals.

Investigators believe this was done to disguise the source of the funds.

On March 12, 2024, police reportedly discovered Sh4.7 million in a KCB Eastleigh account registered under Fatzam Enterprises Limited and operated by Abdile and Barre.

More than Sh107 million was also traced to FEL accounts held at Absa, KCB, and Equity Bank.

Fake Import Transactions Alleged

The court heard that the accused allegedly used fake importation transactions as a cover.

On August 20, 2024, they allegedly arranged a payment of $8,300 (about Sh1.07 million) to an overseas milling company.

The payment was claimed to be for spaghetti imports.

However, investigators believe the transaction was meant to disguise proceeds of crime.

Additional Foreign Currency Charges

Further charges relate to:

  • Concealment of tens of thousands of US dollars

  • Transfers of millions of shillings to local companies

  • Retention of Sh45 million in an Equity Bank account

The prosecution stated that on July 1, 2020, Abdile retained Sh45 million in an Equity Bank account while falsely claiming it was for an import transaction.

Court Grants Bail

Mohamed Osman Abdile denied all charges.

He applied for release on bond and assured the court he would attend trial.

The prosecution did not oppose the application.

The magistrate granted him:

  • Sh3 million bond

  • Alternative Sh2 million cash bail

The court also directed the prosecution to supply witness statements to enable the accused to prepare his defence.
