Sh102 Million Fraud Case Against Mwingi West Aspirant Adjourned to February
The trial of a politician accused of defrauding a company Sh102 million has been postponed, with the court setting a new hearing date in February.
The case involving Jonathan Ngenga Ndisya and Peter Kamau Njuguna will now be heard on February 20 before Milimani Chief Magistrate Lucas Onyina.
Alleged Sh102 Million Fraud Scheme
Ndisya, who is seeking the Mwingi West parliamentary seat, is charged alongside Njuguna with defrauding Agro Irrigation & Pump Services Limited.
According to the charge sheet, the alleged offence was committed between July 1, 2018 and March 31, 2020 at the company’s offices in Nairobi County.
The prosecution alleges that the two jointly conspired to defraud the firm through false representations.
False Deposit Claims
The court heard that Njuguna was employed as an accountant at Agro Irrigation & Pump Services Limited, while Ndisya was a director of Joncil Enterprises.
It is alleged that the accused persons falsely claimed that Joncil Enterprises had deposited Sh106,822,690 into the bank account of Agro Irrigation & Pump Services Limited as payment for goods supplied—claims prosecutors say were untrue.
Additional Theft Charge Against Accountant
In a separate count, Njuguna is accused of stealing Sh4,777,094 from the company by fraudulently transferring the money to his personal account.
The charge sheet states that the funds came into his possession by virtue of his employment as an accountant.
Accused Out on Bail
Both Ndisya and Njuguna have denied the charges and are currently out on cash bail.
The matter will next be mentioned and heard on February 20.
