James Mwangi, Jane Wangui Ordered to Deposit Sh10m in Muthaiga Land Appeal
James Mwangi and his wife Jane Wangui secured temporary relief at the Court of Appeal, but only after agreeing to deposit Sh10 million as security in their ongoing dispute over a contested Muthaiga property valued at Sh1 billion.
The bench comprising Daniel Musinga, Patrick Kiage, and Ole Muchelule recorded a consent order preserving the status of the property pending the hearing of the appeal.

What the Court Ordered
The judges declined to grant an outright stay of execution of the High Court judgment delivered by Oscar Angote. Instead, they issued a “status quo” order.
In effect:

The Muthaiga property cannot be sold, transferred, or interfered with

Mwangi must deposit Sh10 million within 60 days

The money will be placed in a joint interest-earning account

The appeal will be fast-tracked
The court also directed that a case management conference be held within 30 days to expedite the matter.
Appeal Still Alive
Although Mwangi remains locked out of the property, the consent order keeps his appeal active. However, the Sh10 million deposit acts as security to protect Mount Pleasant Limited, which claims ownership of the land.
The appellate court signaled that it intends to conclude the matter swiftly. Until then, the property remains untouched.
What Happens Next
The legal dispute centers on whether the land registration process was flawed or improperly handled. That question will now be determined by the appellate judges.
For now, the contested Muthaiga property remains frozen, and the high-stakes battle continues in the Court of Appeal.
