Kenyan businessman Holy Field Miyogi has been arraigned before the Kibera Law Courts over allegations of defrauding Acacus Trading Kenya Limited of goods valued at Sh47 million.

According to court documents, Miyogi, together with other suspects not before the court, allegedly conspired to steal assorted fashion retail stock items between August 1, 2023, and October 30, 2023, at Wetlands in Gigiri Sub-County, Nairobi.

Court Proceedings

Miyogi appeared before Senior Principal Magistrate Margret Murage, where he denied the charges and requested a lenient bond term through his lawyer.

The defense argued that Miyogi was not a flight risk and would cooperate fully with the investigation. The prosecution did not oppose his release on bond, paving the way for the magistrate to grant bail.

The court set Miyogi’s bond at Sh2 million, with an alternative cash bail of Sh200,000, alongside a surety of the same amount.

Arrest Warrants for Other Suspects

The magistrate also issued warrants of arrest for three other suspects linked to the fraud — Peris Kiok, Nicole Masika, and Maurine Masika — after they failed to appear in court for plea-taking despite being released earlier on police cash bail.

Authorities maintain that the case involves a well-coordinated fraud scheme, targeting a company in the fashion retail sector.

What’s Next

The court directed that the matter be mentioned at a later date for further directions as investigations continue.

The Directorate of Criminal Investigations (DCI) is expected to dig deeper into the case to establish the whereabouts of the missing stock and determine the role of the other suspects.

The outcome of this case is being closely watched, as it highlights the growing wave of white-collar crime and corporate fraud affecting Kenyan businesses.
