Court declines urgent application

Justice Rosslyn Aburili ruled that the matter did not meet the threshold for urgency.

“This court finds that there is no urgency disclosed… I decline to certify the matter as urgent,” the judge stated.

The court also declined to issue conservatory orders to halt investigations or possible prosecution.

Bribery allegations linked to Tuju case

Wachira has been mentioned in connection with bribery allegations tied to a dispute involving Raphael Tuju and his Karen property.

He was recently arrested alongside former judge Joseph Mutava over an alleged Sh10.4 million bribery case.

EACC and DPP powers upheld

The state opposed the application, emphasizing the legal mandate of the Ethics and Anti-Corruption Commission and the Director of Public Prosecutions.

State counsel argued that:

  • EACC has authority to investigate bribery cases

  • DPP has independent prosecutorial powers

  • The Attorney General was wrongly included in the case

Court dismisses urgency claims

The judge noted that Wachira had already been granted cash bail by EACC on March 10, allowing due process to continue.

The court directed him to:

  • Serve the petition to all respondents

  • Proceed through the normal court process

Wachira claims entrapment

Wachira maintains that:

  • The bribery allegations are fabricated

  • His arrest was staged and orchestrated

  • He was targeted in a planned entrapment scheme

He further claims that evidence supporting his position has been ignored by investigators.

State response

State counsel insisted that:

  • The petition is frivolous and without merit

  • The Attorney General has no direct role in the matter

  • Independent agencies must be allowed to operate without interference

What happens next

The ruling now clears the way for:

  • Continued investigations

  • Possible re-arrest

  • Formal prosecution
