The Charges

According to the charge sheet read in court, Boro and Mbugua are accused of jointly obtaining Sh3,800,000 from Eva Waithera between February 20, 2024, and other dates in Nairobi.

The prosecution alleges that the money was obtained by falsely claiming it would finance the purchase of dry maize grains from Eldoret.

Boro is also accused of obtaining an additional Sh1,145,000 from Bernard Ngirita under similar circumstances.

Separately, Mbugua faces charges that between January 4, 2024, and April 3, 2024, he obtained Sh4,350,000, allegedly by falsely claiming the funds would be used to finance maize purchases.

In a separate count, one of the complainants is alleged to have been defrauded of Sh581,000 in January 2024.

Bail and Custody

The prosecution opposed Boro’s release on bail, arguing that she could abscond due to the existence of other matters pending before various courts.

Mbugua was released on a bond of Sh900,000 or an alternative cash bail of Sh400,000.

The court ordered that Boro remain in custody until March 20, 2024, pending further directions.

Presumption of Innocence

Both accused persons have denied the charges and remain presumed innocent unless proven guilty in court.

The case will proceed as scheduled before the Milimani court.
